Monday October 30, 12:10-1pm, Jerome Greene Hall, Room 107:
“Jurisdictional Issues in Antitrust: Intel & Beyond”
The EU Courts have consistently held that the application of EU law to a specific situation presupposes an adequate link to the EU territory. However, until recently, only few decisions of the EU Courts concerned, more specifically, the scope of application of EU competition rules. In past cases, the Court of Justice had found that the adequate link to the EU territory could be the presence in the Union of a subsidiary of the company concerned, or the implementation of anticompetitive conduct within that territory. In addition, the General Court had also endorsed a ‘qualified effects’ test. The question of jurisdiction was, however, one of the key issues raised by the well-known Intel case. Advocate General Nils Wahl, in this talk and discussion, will focus of the potential consequences of the Intel judgment.
Lunch will be served.
